By downloading or using Better Captain ("the app") you agree to these terms. If you do not agree, do not use the app.
License
The app is licensed to you, not sold, for personal use on Apple Watch devices you own or control, under the Apple Media Services Terms and the standard Apple Licensed Application End User License Agreement (EULA), which apply in addition to these terms.
A navigation aid only
Better Captain is a navigation aid. It does not replace approved man overboard procedures, your boat's own MOB function, a personal AIS beacon or PLB, official charts, a VHF radio, or good seamanship. GPS accuracy varies with conditions, and the app can fail or be unavailable because of a flat battery, loss of GPS signal, a watch fault or a software error. The anchor alarm and man overboard guidance are aids and are not guaranteed to alert you or to lead you to a person or position. You remain solely responsible for the safe operation of your vessel and the safety of everyone on board.
No warranty
The app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted operation, to the extent permitted by law.
Limitation of liability
To the extent permitted by law, the developer is not liable for any loss, damage, injury or death arising from use of, or inability to use, the app. Nothing in these terms limits liability that cannot be limited by law.
Acceptable use
Do not copy, modify, reverse engineer or redistribute the app except as permitted by law or the Apple EULA.
Privacy
See the Privacy Policy. The app collects no personal data.
Changes
These terms may be updated. The effective date above shows the latest version; continued use means you accept the update.
